Osh Wellness Inc ("Osh Wellness", "Osh", "us", "we", or "our") operates the https://oshwellness.com website (the "Service"). This page (“Privacy Policy”) informs you of our policies regarding the collection, use, and disclosure of personal data when you use our Service and the choices you have associated with that data. We use your data to provide and improve the Service. By using the Service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms of Service, accessible from oshwellness.com
PERSONAL INFORMATION WE COLLECT
When you visit the Service, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Service, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Service, and information about how you interact with the Service. We refer to this automatically-collected information as “Device Information.”
We collect Device Information using the following technologies:

BEHAVIOURAL ADVERTISING

DO NOT TRACK
Please note that your browser settings may allow you to automatically transmit a “Do Not Track” signal to websites and online services that you visit. There is no consensus among industry participants as to what “Do Not Track” means in this context. Like many websites and online services, we do not alter our practices when we receive a “Do Not Track” signal from a visitor’s browser.
HOW DO WE USE YOUR PERSONAL INFORMATION?
We use the Order Information that we collect generally to fulfill any orders placed through the Service (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:

- Screen our orders for potential risk or fraud; and
- When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

We may employ third party companies and individuals to facilitate our Service ("Service Providers"), to provide the Service on our behalf, to perform Service-related services or to assist us in analyzing how our Service is used. Osh Wellness may disclose your personal data in the good faith belief that such action

The Service is hosted in the United States. Such entities may be engaged in, among other things, the provision of support services.
LINKS TO OTHER SITES
Our Service may contain links to other sites that are not operated by us. If you click on a third-party link, you will be directed to that third party's site. We strongly advise you to review the Privacy Policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.
CHILDREN'S PRIVACY
Our Service does not address anyone under the age of 18 ("Children"). We do not knowingly collect personal information from anyone under the age of 18. If you are a parent or guardian and you are aware that your Children has provided us with personal data, please contact us. If we become aware that we have collected personal data from Children without verification of parental consent, we take steps to remove that information from our servers.
PUBLIC POSTING AREAS
Please note that any information you post to any public posting area, such as the comment section of our social media sites, our blog, or when you provide product reviews, is available to anyone with Internet access worldwide. If you don't want people to know your email address, for example, don't include it in any message you post publicly. DISCLAIMER REGARDING VIDEO CONTENT
The Service may contain video content, audiovisual content, or content of a like nature (collectively, “Video Content”). In connection with our provision of Video Content, the Service may utilize online tracking technologies and code-based tools, including, but not limited to, Software Development Kits (“SDKs”), pixels, and cookies (i.e., advertising or analytics cookies) that track information about your activity and webpage-viewing history on the Service (collectively, “Tracking Tools”). Tracking Tools on the Service may result in information about your activity on the Service being transmitted from your browser to Osh and third parties, which, in turn, may result in the display of targeted advertisements on third-party websites, platforms and services, including advertisements for Osh content. In addition, whether Tracking Tools on the Service result in your browser’s transmission of information to third parties depends on a number of factors that may be outside of Osh’s knowledge or control, including what third-party websites you use, what information you have provided to such third parties, and whether (and the extent to which) you have limited the use of cookies by the operators of those third-party websites, platforms, and services.
OUR USE OF CHAT FEATURES AND SESSION REPLAY TECHNOLOGY
We may use session replay or other analytics technologies offered by third parties to monitor how you interact with our Service. The personal information collected by this technology may include, but not be limited to, which links you click on, pages and content you view, information that you type into our online forms, recordings of mouse clicks and movements, and information about your device or browser.
Our Service may also have third-party chat features for support purposes. These features may collect the content of your communications and other personal information you provide while interacting with the chat feature. Please discontinue use of the Service if you do not consent to the collection of such information by us and third parties.
YOUR RIGHTS

We will endeavor to comply with your request as soon as reasonably practicable. You may sign up to receive emails or other communications from us. If you would like to discontinue receiving this information, you may update your email preferences by using the “Unsubscribe” link found in emails we send to you or by contacting us as provided below. Please note: if you unsubscribe from marketing communications, you may still receive transactional or relationship emails from us.
California “Shine the Light”. California’s Shine the Light law gives California residents the right to ask companies what personal information they share with third parties for those third parties’ direct marketing purposes. We do not disclose your personal information to third parties for the purpose of directly marketing their goods or services to you. Nevada Disclosure. Residents of Nevada have the right to opt-out of the sale of certain pieces of their information sold to third parties. Currently, we do not engage in such sales. Mobile Terms of Service

The Osh Wellness Inc mobile message service (the "Mobile Service") is operated by Osh Wellness Inc (“Osh Wellness”, "Osh", “we”, or “us”). Your use of the Mobile Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Mobile Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Mobile Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Osh Wellness Inc’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Osh Wellness Inc through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. The mobile messaging service used by Osh Wellness to communicate with you does not have the capacity to generate telephone numbers or initiate messages without human intervention. Thus, our mobile messages are not sent to you by an automatic telephone dialing system (“ATDS” or “autodialer”). Nevertheless, by opting into the Mobile Service, you agree to receive autodialed mobile messages, including promotional messages, and you understand that consent is not required to make any purchase from us.
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Osh Wellness Inc. Your participation in this program is completely voluntary.
We do not charge for the Mobile Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Mobile Service at any time. Text the single keyword command STOP as a reply to any of the text message received from Osh Wellness or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Osh Wellness Inc mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages. You may receive an additional mobile message confirming your decision to opt out. The Service may recognize or respond to additional commands and keyword queries. Thus, you may receive additional informational text messages based on your interaction with the Service, even after opting out of receiving the Service’s recurring alerts. You acknowledge and agree that, notwithstanding any prior opt-out attempt, you consent to receive further messages from or on behalf of Osh Wellness that result from your continued communication with the Service. Osh Wellness may also provide you instructions on how to rejoin receiving the Service’s recurring mobile alerts when you unsubscribe. You agree that you are subject to the Mobile Terms, including any modifications thereto then in effect, when you resubscribe to the Service through any of the available options to do so.
The wireless carriers supported by the Mobile Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Mobile Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Mobile Service. If you are dissatisfied with the Mobile Service or any content provided by Osh Wellness, your sole remedy is to discontinue participating in the Mobile Service. You acknowledge that your participation in the Mobile Service is at your own risk. IN NO EVENT SHALL OUR LIABILITY FOR ANY AND ALL CLAIMS RELATING TO THE USE OF THE PROGRAM EXCEED THE TOTAL AMOUNT OF FEES THAT YOU PAID US DURING THE ONE-YEAR PERIOD BEFORE THE SPECIFIC CLAIM AT ISSUE, OR $100, WHICHEVER IS LESS. WE WOULD NOT BE ABLE TO MAKE THE PROGRAM AVAILABLE TO YOU WITHOUT THESE CONDITIONS IN THE TERMS, AND THE FOREGOING PROVISIONS ARE THUS AN ESSENTIAL PART OF THE OFFER TO YOU. IF YOU DO NOT ACCEPT THESE TERMS, DO NOT OPT INTO THE MOBILE SERVICE.
